Thank you for using www.nigelmilne.co.uk (the ‘site’). These terms and conditions govern your use of the site and purchase of goods and services from the site. You will find information on your privacy and your security on other pages of the site and these pages shall be incorporated into these terms and conditions. If you have any questions, please contact us by using the “contact us” form. In these terms and conditions, “we”, “us”, “our” and nigelmilne.co.uk means Nigel Milne Limited (a company registered in England under company number 1410323 with registered address at 42 Berkeley Square, London, W1J 5AW. VAT number 242 8087 60.

Please read these terms and conditions carefully before using the site. By accessing the site and/or placing an order, you signify your agreement to be bound by these conditions and you consent to us using your information in accordance with our privacy policy. If you do not accept these terms, do not use the site.

You must be 18 years of age or older to purchase goods from the site. If you are under 18, you may use the site only with the involvement of a parent or guardian. Your use of and registration on the site is void where prohibited.

HOW TO ORDER ON LINE

Ordering from Nigel Milne is very simple: order online before 1:00pm or call us on 0207 491 9201 and your item(s) will be sent by special delivery the same day (where possible however please note that orders may be sent the following day), and should arrive the next working day (Monday to Friday) within the UK. In central London we can often deliver your order by courier the same day it is made. Please note that orders can only be dispatched to the credit card billing address unless you are an existing customer or have made a previous purchase online. To request a different delivery address, please e-mail us at jewels@nigelmilne.co.uk after you have placed your order.

To check the status of an order or verify shipment, please call 0207 491 9201 from Monday to Friday from 11am to 6pm or e-mail us at jewels@nigelmilne.co.uk and someone will be able to help you. Once your order has been processed, we will send you an e-mail containing a link to a page that will allow you check the delivery status of any purchase you have made.

All items sent by Special Delivery, International Signed For or by FedEx will have a unique tracking number and we will also e-mail this to you for your records.

We accept VISA, MasterCard, Switch, Maestro and American Express (Amex).

All orders will be charged in GBP pounds sterling.

Please also note that any duty and taxes incurred in the country of destination are the responsibility of the client

To securely receive your payments over the Internet we use Sagepay technology who provide secure online credit card and debit card solutions for thousands of online mail order businesses across the UK. Sagepay has achieved the highest level of compliance under the Payment Card Industry Data Security Standard (PCI). They adhere to the most stringent levels of fraud screening, ensuring that our customer details remain secure throughout the transaction process. You can be assured your details are safe.

Please don’t try to send orders via email, as we cannot guarantee any secure transmission of details. We will take all reasonable care to keep your order secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data (including credit and account details) you provide when accessing or ordering from the site. If you’re still worried about security over the Internet, then please contact us by phone.

Please note that regrettably we are unable to ship goods to any country in Africa.

DELIVERY

Delivery charges are as follows:

Delivery to UK addresses is by Royal Mail Special Delivery and is charged at £7.50.

Free delivery on orders over £1,000.00 (UK only) next working day delivery.

Courier service (Central London postcodes only) - £15.00 same day delivery.

If you place your order on line, your order will be despatched as soon as funds reach our bank account which is usually three working days. If you order over the telephone before 1pm, your order will arrive by Royal Mail Special Delivery the next working day (Monday to Friday only), excluding all Bank Holidays.

If you place your order after 1pm on Friday, it will be processed on Monday and delivered before 1pm on Tuesday.

All orders must be signed for at point of delivery. If your order is returned because no signature was obtained or for any other reason such as postal strikes, you will be responsible for all return and re-delivery charges.

If someone unauthorised signs for your purchase at the address you have given us, it will not be the responsibility of Nigel Milne Ltd.

Delivery time is subject to product availability and clearance of your payment.

Signed For International delivery(for non UK orders under £500) - £20.00 delivery charge; approximately 6 working days to most destinations.

FedEx delivery (for non UK orders over £500) - £50.00 delivery charge; approximately 2 working days

If you would prefer not to have your purchase sent to you, you may collect your online order from our shop at 42 Berkeley Square, London, W1J 5AW. Please bring the credit/debit card you used to place the order as proof of purchase. Collection will not incur any extra charge.

RETURNS PROCEDURE

In the unlikely event that you are unhappy with your purchase, please take the following action:

  1. Please notify us by writing to Customer Service Department, Nigel Milne Ltd, 42 Berkeley Square, London, W1J 5AW or e-mail us at jewels@nigelmilne.co.uk within 7 working days from the date you received your goods.
  2. The item(s) must then be returned by Royal Mail Special Delivery, Courier or if outside of UK, via Fedex within 14 calendar days of invoice date to :Nigel Milne Returns

NB please retain proof of postage as we cannot be held responsible for parcels lost in transit.

  1. All items must be returned in an unused (re-saleable) condition, in all their original packaging, proof of purchase and with the security tag still attached.
  2. The customer is responsible for the postage costs incurred when returning an item. We cannot be held responsible for any item returned to us in any other way.

Items may be returned for an exchange or credit note. If all of the above conditions have been met, then we will refund the price of the items minus 5% handling charge only. There will be no refunds for any delivery charges.

For hygiene reasons we regrettably cannot exchange or refund earrings, unless they are defective or faulty. We also cannot exchange or refund items engraved or in anyway personalised unless they are defective or faulty.

If the products you return are faulty, incorrect or damaged in transit, we will refund you the cost of the return postage, as well as the goods and your original postage and packing charge providing there is no evidence of the goods being damaged after delivery.

NIGEL MILNE LTD PRODUCTS

Every effort is made to assure accurate impression of our products through Nigel Milne Website. However, some images may not be to scale and the colours shown may vary depending on the individual computers and monitors and their settings. Nigel Milne Ltd reserves the right to change product specifications and prices at any time.

CONTRACT OF SALE

The advertising of products and services on this site is an offer and no contract of sale is formed between you and Nigel Milne Ltd until you receive the confirmation of order e-mail. Orders shall be accepted at our sole discretion but are normally accepted once credit card authorisation has been confirmed, the order reflects current pricing, stock levels have been checked. Once we accept your order, you shall pay the price for the goods (which includes VAT) and delivery and we shall charge your account for payment. Please keep your “confirmation of order” e-mail for your records.

In exceptional circumstances, if we are not able to fulfil an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email. In no circumstances will we be liable to you for any additional amounts.

These terms and conditions cannot be varied except by changes made by Nigel Milne Ltd on the site, which we may make from time to time. Changes to the terms and conditions will be notified on nigelmilne.co.uk, you should review these pages for details of any amendments to our terms and conditions on each purchase. Your continued use of the site after such notification shall be taken as your full acceptance of such changes. You will only own the goods you purchase once they have been successfully delivered and when we have received cleared payment for them in full. Until that time we will retain title to the goods. Goods supplied are not for resale.

VAT

VAT is included in all prices advertised on www.nigelmilne.co.uk and therefore included in all orders with a delivery address inside the EU at the UK rate of 20%. If you are not an EU member then you will have a zero rate of VAT applied to your order when you login and confirm your delivery address. We follow the guidelines as laid out by HMRC in ‘VAT: Export of goods from the United Kingdom’. Please note: Items sent within the EU (but outside the UK) will NOT be charged VAT on the delivery cost.

CANCELLATIONS

If you realise you have made a mistake and want to cancel your order, please contact us as soon as possible. Since we ship quickly, it may not be possible to stop your order so please follow the instructions for making returns in those instances. Please follow these instructions for exchanges as well. It will be faster to re-order a product rather than send it back for an exchange, so please follow the above instructions while you order the product you would like instead. We realise this means two transactions on your credit card but feel it is faster for you to get the product you would like. If we are personalising or engraving your order we cannot cancel it if we have already started the work.

CANCELLATION BY US

We reserve the right to cancel the contract between you and us if: a) we have insufficient stock to deliver the goods you have ordered; or b) we do not deliver to your area; or c) one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

DISCLAIMER AND LIABILITY

We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time. We will endeavour to ensure that all descriptions and illustrations of the items on the site or in our catalogue or otherwise provided to you by us are accurate but there may be slight variations due to print and publishing limitations. Nigel Milne Ltd work to keep the site up to date but cannot guarantee that this site and its contents are completely free of technical errors, viruses or anything else that may have a harmful effect on any technology. We will endeavour to allow uninterrupted access to the site but access may be suspended, restricted or terminated at any time. By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site.

In no event shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, or otherwise arising out of or in connection with the terms and conditions or use of the site save where such liability cannot be excluded by law.

You must use the site for lawful purposes only. If we allow you to register with us you are fully responsible and liable for all access made to the site using any password or user name that you register with us. You should keep such passwords and user names confidential at all times.

To the maximum extent permitted by law, our liability to you in connection with any claim or series of connected claims under these terms and conditions shall not exceed £1,000 or the value of the goods to which a claim is relevant, whichever is the greater.

Notwithstanding anything else in these terms and conditions, we do not exclude or limit our liability in respect of death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

These terms and conditions do not affect your statutory rights (if appropriate) as a consumer.

We shall not be liable to you or in breach of these terms and conditions for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control.

CUSTOMER RESPONSIBILITY

Nigel Milne cannot guarantee that the sale and delivery of its goods to your particular country or location is permissible, so please be aware of your own geographic import restrictions

This site and its contents will not constitute the basis for any contractual commitment between Nigel Milne and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of products by Nigel Milne would contravene any applicable local, regional or national legislation. No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for Nigel Milne to sell products.

LEGAL GOVERNANCE

Your use of this site and any contract between you and Nigel Milne for the sale of products shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions. If we fail to enforce a right under these terms and conditions, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.

Unless otherwise stated in these terms and conditions, no part of these terms and conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.

We are the operator of www.nigelmilne.co.uk. All trademarks, product names and company names, photographs or logos sited here are the property of their respective owners. No permission is given by us in respect of the use of any such trademarks, product names and company names, photographs or logos and such use may constitute an infringement of the owners’ rights.

The contents of the site and the site as a whole are intended solely for personal, non-commercial use. You may download or make a single copy of the contents and other downloadable materials displayed on the site for the sole purpose of placing an order with Nigel Milne or using the site as a shopping resource. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying.
